The family of a 51 year-old man who died while in custody at the Santa Rita Jail has settled their lawsuit for $1 million.

Court documents alleged that deputies beat, kicked, tased, improperly restrained and brutalized the man inside his cell block.  He died approximately 48 hours later.

Half of the settlement is being paid to Martin Harrison's 10 year-old son by Alameda County.  The county jail's healthcare provider,  Corizon Health, will need to pay the balance.

Harrison was arrested in 2011 after he failed to appear in court after being arrested for drunk driving.  Family members say he definitely had a drinking problem, but was was healthy otherwise.

An attorney for the man's son say the child continues to be devastated at the loss of his father.

Sources close to the case say the incident may have been stemmed by alcohol withdrawal.  Deputies let themselves into Harrison's cell after he started to behave erratically.  He was screaming, breaking things and blocking the toilet.   His jailers tried to restrain him, but the man eventually broke free.

That's when another deputy pulled out his taser, saying the inmate was coming at him in an aggressive manner.  Prior to this incident, he said, Harrison had been quiet and humble, and mostly kept to himself.

The lawsuit further alleged the inmate did not receive proper medical care after the incident.  The family believes the jail's healthcare provider may have been negligent, which may be a factor in the man's death.

Harrison reportedly has four other adult children who are also seeking damages in the case.  Those matters have not yet been resolved.
