    When an individual is arrested, generally, they will be taken to a local law enforcement station for processing and booking. Processing and booking can take a considerable amount of time, but in smaller jails generally happens quickly.

    After they have been booked, three things may happen:

    • Defendant may be released with no charges filed.
    • Bail and arraignment may be set by the jail or court. The defendant must post the bail bond amount or make arrangements with a bail bond service to have a bond posted in order to get out of jail.
    • Defendant may be released on their Own Recognizance.

    HOW DO BAIL BONDS WORK

    A bail bond, technically a "surety bond", is a contractual undertaking guaranteed by a state licensed bail bondsman who is backed by an insurance company. The bail agent guarantees to the court payment of the full amount of the bond if the defendant fails to appear for their scheduled court appearances.     The co-signer of the contract (usually the arrestee or a friend or relative of the arrestee) guarantees to pay the full amount of the bail if the defendant fails to make scheduled court appearances.

    PROCEDURES FOR BAILING SOMEONE OUT OF JAIL
