Setting Bail
After arrest and processing at the Santa Clara County Main Jail, the bail amount is set according to a published Santa Clara County Bail Schedule which is set by judges on a county-wide basis.
While you can use the bail schedule as a guide as to what to expect for a bail amount, bail may be increased due to extenuating circumstances or may be decreased or increased at the direction of a judge.
Bail Options
As a bail consumer, you may choose to use a bail bondsman and will be paying 10% of the full amount of the bail.
The bail agent will handle all the particulars of the transaction such as providing you with the appropriate California bail forms and posting the bond with the jail or court.
You also have the choice of not using a bail bondsman, which means you would pay the full amount of the bail in cash or with a cashier’s check to the jail or court. Be aware that these funds will be tied up until the case is completed, which may be an extended period depending on the case. If you pay by cashier’s check, make sure that the check is made out to the correct payee by checking with the jail in advance. If there is a discrepancy the jail will not take the check.

The Santa Clara County Main Jail Complex is in the city of San Jose. This jail facility is separated into the Main Jail North and Main Jail South. The main Jail North is equipped to detain approximately 1000 inmates. The Main Jail South is designed to hold approximately 650 inmates.
