Fact: Inmates Can’t Use Their Cell Phones To Make Calls

When someone is arrested and taken to jail, at some point, they are provided access to a phone; if the defendant can't remember any phone numbers, they may be out of luck.

Jailers always take an inmates personal possessions as part of the county jail booking process.  This can include everything from confiscating watches, purses, jewelry, car keys and yes, this includes the defendant's cell phone.  These items will be returned to an inmate when they are released but they won't have access to any of it while they remain in custody.

Although it is common practice for the jail to …

Another San Joaquin Makes A Run From The Honor Farm

Sources close to the San Joaquin County Jail Honor Farm have confirmed yet another inmate has tried to escape from its walls.

The now fugitive is 19 year-old Pedro Arquiaga, who was last seen just before noon on Saturday.  When officers did the 12 o'clock count, he was gone.  Jail officials say the defendant was booked into the facility on Nov. 1 and was reportedly charged with vehicle theft, hit and run, burglary, obstructing a police officer and receiving stolen property.

It's not immediately clear if he was still eligible to post bail bonds at the time of his escape or …

The True Cost Of DUI Is Much Higher Than You Think

People who chose to drive while under the influence of alcohol or drugs are not only putting themselves, and others at risk; if they are arrested they could find themselves being buried under a pile of crippling debt.

Although many places in California will release first-time drunk drivers on their own recognizance, some places, such as the San Diego Central Jail, always require that a defendant post bail bonds.

Bail for this offense can be as low as $2,500 or as high as $100,000 depending on what happened during the arrest.  If the defendant got into an accident where another person …

Alleged Bank Robber Steals Cab To Make His Getaway; Gets Arrested

People in California seem to have an odd habit of stealing taxi cabs so they have a fast way to get from point A to point B.

Last year, a San Diego man stole a taxi so he could drive himself home from jail. (Suffice to say, that didn't exactly work out in his favor.)

This time the incident took place in Santa Ana; members of the local police department say that last last week a suspected bank robber decided to carjack a taxi in hopes of getting away with his loot.

Santa Ana Police Department officials say the incident took pace …

OC Considers Mass Overhaul To Bail Bonds System

Sources close to the Orange County Jail system say the county is considering moving forward with a pilot program for some of its inmates. If approved, jails will take a more risk-based approach deciding which defendants are released before their first court date.

Proponents say there are a number of pre-trial defendants who remain behind bars because they cannot afford to post bail bonds.
Creating Risk While Evaluating Risk
Opponents feel the proposed change in the system is a risky move. When an individual is released from jail through bail, the bail bonds company and the person who signed the bail contract …

Top 5 Holiday Travel Tips To Keep You Safe

Holiday travel can be as hectic as it is stressful, but if you take the time to make a mental note of these five tips, you're bound to come out ahead of the game.
1. Be careful what is in your suitcase
Each year, bail bonds companies get countless calls from airline passengers who didn't know they were carrying "contraband" in their carry-on suitcases.
Things such as pocket knives, brass knuckles can be flagged as weapons by the TSA. Oddly, some we've had calls from people who literally didn't know they had a hand gun in a carry-on.
If a passenger is found …

What Bail Bonds Accomplish for Criminal Justice System

Last week, Louisiana-based newspaper published an op-ed from from the Executive Director of the state's ACLU that essentially slammed the commercial bail industry.

Her perspective seems to be that the bail bonds industry is the root of the the problems in the Louisiana criminal justice system. Her thesis being that pre-trial defendant's are in jail because they are financially disadvantage and greedy bail agents want to keep the system in place.

This week, ExpertBail's Eric Granoff helped to set the record straight in his article "What's Right With the Louisiana Bail System?"

Granoff focuses the roll of jail and the bail industry …

How Ballot Question 1 Could Change Bail Law

Voters in New Jersey today will be voting on a proposed constitutional amendment that, if approved, could fundamentally change how the state's bail bonds system works.

Ballot Question 1 proposes to alter the state Constitution to allow judges to implement no-bail holds on suspected violent offenders.  This means defendants who have been accused of heinous, serious crimes such as murder, homicide and others, can be denied bail.

Proponents point out that if the measure is passed, it will also pave the road for a second big change; namely, allowing judges the discretion to release certain, low-level offenders on their own recognizance.  …

Haunted Jail Museum Opens For Halloween

A cold, abandoned jail in Texas has been transformed this Halloween, the county's historical commission says it's chock full of goblins, ghouls and things that go bump in the night.

Many local residents say that if they haven't already been to the jail, they plan on making the trip with their families.  Seeing an abandoned, "haunted" detention center is a perfect scary outing to pair with the Oct. 31 holiday.

Organizers say that when visitors arrive they'll be taken on a guided tour of the first and second floors of the building.  On the ground floor, ghosts can be seen throughout …

New Policy In Sonoma Could Double Bail Bonds Cost

When someone is released from the Sonoma County Jail on bail bonds, prosecutors have 15 days to file formal charges against the defendant.  If they don't, the bail bonds expire.

This week, judges say they are going to start observing these strict time limits.  If the District Attorney's office files charges after that time frame, the court says they'll require a new bond be posted.

Opponents of this decision call it an essential doubling of the county bail schedule, and point out that if families can't afford to pay twice, the defendant will be stuck behind bars until their case is …
