The Navy officer who pointed an assault rifle at San Diego police officers during an hour-long standoff at a local apartment building October 14 has pleaded not guilty to his charges, the San Diego Union-Times reported. He is being held on a $100,000 bail.
Petty Officer 2nd Class Esteban Nandin was wandering around the apartment building wearing a tactical vest, gas mask and carrying a military-style rifle when the San Diego Police Department arrived on scene. Nandin was shot by a police officer after he pointed his rifle at him, the U-T reported.
Nandin was taken to a hospital for treatment of his wounds, where he remained during his arraignment October 17, the news source stated. If convicted on his one count of exhibiting a firearm to a police officer, Nandin could face up to three years in prison.
Nandin's defense attorney said Nandin's guns were not loaded with ammunition during the incident and he was wearing a Camelback waterpack, not a tactical vest as authorities have said, the U-T reported. Nandin is stationed at the Coronado Naval Amphibious Base, and Navy officials told the new source he works as an electronic technician for an explosive ordinance disposal unit.
The attorney also said Nandin is scheduled to have a surgery due to his gunshot wound, but did not elaborate on his client's condition, according to the U-T.
Another U-T article reported the identity of the San Diego police officer responsible for firing the shot that wounded Nandin during the standoff. Charles Marciniak has been named as the officer responsible for shooting Nandin after opening a stairwell door at the apartment building and coming face to face with the suspect holding the assault rifle. Marciniak has been a police officer in San Diego for 18 years and is a canine handler, the article stated.
