A San Diego man is scheduled to be arraigned on October 10 after he was pulled over on suspicion of drinking and driving and released on bond. According to The Desert Sun, 40-year-old Alberto Alvarez was arrested on August 13 after allegedly being involved in a car crash on a local highway.

Sheriff's Sergeant Brad Farwell told the source that someone reported the crash, which was allegedly caused by Alvarez's Ford Expedition side swiping a Chevrolet Cobalt after failing to properly switch lanes.

“The driver of the Ford Expedition initially stopped in the area and then drove away from the area at a high rate of speed,” Farwell said, according to the Sun.

Law enforcement officials apprehended Alvarez in Palm Desert. Following his arrest, he was booked into the county jail in Indio and posted a $2,500 bail bond the following day.

When a bail bond amount is set, it is generally based on the severity of the situation. In California, the bail for driving under the influence would be based on whether the defendant allegedly caused an accident, injury or death. According to the website California DUI Information, the charges for a DUI are placed in three separate categories in California: misdemeanors, felonies or wobblers, which could be defined as a misdemeanor or felony.

California's Vehicle Code Section 23153 states that a driver will be arrested if any alcohol or drugs are detected in his or her system.

“Any person who, while under the influence of intoxicating liquor, or under the combined influence of intoxicating liquor and any drug, drives a vehicle and when so driving does any act forbidden by law or neglects any duty imposed by law in the driving of such vehicle, which act or neglect proximately causes bodily injury to any person other than himself, is guilty of a felony,” the law states.

Driving under the influence in California can result in up to a year or more in jail. If a person is arrested for a DUI in San Diego, he or she may have to stay in a San Diego jail until appearing in court, regardless of whether an injury occurred as a result of the DUI, unless bail is posted.
