A man in Orange County was driving drunk at a high rate of speed when he allegedly killed his brother and injured his nephew. According to the Orange County District Attorney's office, Felix Jacobo Brito is charged with one felony count of vehicular manslaughter while intoxicated without gross negligence.

He is also charged with a felony count of driving under the influence and causing bodily injury as well as a misdemeanor of driving a motor vehicle without a valid license.

Brito​, 37, allegedly crashed his vehicle during the early morning hours of March 11 after he got behind the wheel while intoxicated, according to the District Attorney's report.

The suspect's brother was riding in the front seat of the truck while his nephew rode in the back. As Brito approached a vehicle in front of him, he drove off the side of the road and struck a light pole and a palm tree. The truck then went through a fence before coming to rest on its side in a flood control channel.

When emergency responders arrived at the scene of the accident, 47-year-old Felipe Brito was pronounced dead and 27-year-old John Andrade was taken to the University of California, Irvine Medical Center. Andrade was treated for several broken ribs as well as other injuries sustained in the accident.

Sentencing enhancements and allegations for causing bodily injury and death to more than one victim and causing great bodily injury will be used in the charges, the District Attorney's office said.

If convicted of the charges, Brito will face a maximum of seven years in prison, the Los Angeles Times reported.

Felix Brito remains in jail and his Orange County bail bond was set at $100,000, according to news reports.
