The Process
Once the arrestee has been brought in on their charges, they will be fingerprinted and their photo will be taken for their “mug shot.” Their record will be checked for prior arrests and warrants and to establish their identity. All of this information will be entered into the computer system for processing. The individual’s personal possessions will be taken and cataloged to be returned when they are released.
Setting Bail
In minor cases the person may be released on their own recognizance. In more serious cases, a bail amount will be set and must be paid in order to be released from jail for the duration of their case. The bail amount is set at a level that the court considers high enough to assure that the accused will return to court and not risk forfeiting the amount of bail that was posted.
Paying for Bail
The accused (or anyone else on their behalf) can pay the bail from their own funds directly to the jail or court in the form of cash. An alternative is to buy a bail bond if the amount of bail is too high for the individual to pay. The fee for purchasing a bail bond is set by each state. In California the fee for a bail bond is 10% of the full amount of bail.
