Judges are responsible for setting bail in California. Sacramento County Judges do this on an annual basis and create what is known as a "Bail Schedule". The type of crime someone has allegedly committed dictates the bail.

The first consideration in setting bail is public safety, followed by "flight risk" (the likelihood a defendant will or will not show up for an appointed court date).

The more serious the crime and the greater the possibility of jail time, adds up to higher bail amounts. Since the purpose of bail is to allow the arrestee to go free until he or she has been convicted of their crime, the amount must be set at a legally reasonable fee.

If a defendant or their family cannot afford the full bail amount, they will turn to a bail bondsman who, in the state of California, will only charge 10% of the entire bail amount.
